1031 Exchange Extensions — the Only Ways Deadlines Move

The 45- and 180-day deadlines don’t bend for hard negotiations, slow lenders, or good excuses. They bend for exactly one thing: federally declared disasters, through IRS relief notices. Knowing the real rule — and the folklore around it — protects the exchange calendar you’re actually on.

How disaster relief works

When FEMA declarations trigger IRS relief (Rev. Proc. 2018-58’s machinery), affected exchangers get their deadlines extended — typically the later of 120 extra days or the notice’s specified date. “Affected” reaches beyond the disaster county: qualifying difficulty closing (a lender, title company, or property inside the zone) can bring outside exchangers within relief. Each notice defines its own scope and dates; when hurricanes, fires, or floods intersect your exchange geography, the IRS disaster-relief page and your QI are the same-day reads (VERIFY specific notice terms — they differ every time).

What never extends deadlines

The list that surprises people: your tax extension (it moves the return, and can rescue the 180-day tax-filing interaction for Q4 sales, but never lengthens the exchange period itself beyond 180); seller delays and repair disputes; financing falling through; QI paperwork errors; death or illness (harsh, but the notices are the only mercy the code shows). Planning around a hoped-for extension is planning to fail.

The posture that never needs one

Extensions rescued real exchanges after Ian, Helene, and the California fire seasons — and every rescued file still wished it had the boring protections: backups identified, closings targeted for day 150 not 179, lenders chosen for reliability over ten basis points. Build the exchange that doesn’t need weather luck; accept the relief gratefully if weather arrives anyway.
